Commercial Manager

ERM are currently seeking a Commercial Manager to join the Perth LPMR team (Liability Portfolio Management and Remediation) to manage a range of project execution activities for Tier 1 mining clients, including contracts, claim management, variations, supporting project controls and financial functions.

The Commercial Manager is a key member of the core project team play and plays a pivotal role in commercial decision-making to ensure the success of our projects.

The role requires contractual and commercial acumen and the ability to liaise with project team members, clients and corporate stakeholders to ensure the commercial success of the project.

Accountabilities

  1. Successful commercial and contract management of large/complex environmental projects in the mining sector.
  2. Providing commercial support to projects and bids.
  3. Provide support in the contract / legal review process.
  4. Providing support to the project on change requests and variations.

Key Responsibilities:

  • Facilitate the timely agreement of appropriate contractual terms between ERM and its clients and subcontractors.
  • Contribute to the renewal or revision of Master Services Agreements (MSA’s) and other similar agreements.
  • Responsible for ensuring that contract terms appropriately capture advice from the Legal team and enables BU Partners to deliver work which aligns with both ERM and client requirements.
  • Lead, and provide support to BU Partners, in negotiating contract terms with ERM clients.
  • Work with other Support Functions across ERM – including, but not limited to, the Insurance, Tax, Finance and HR teams.
  • Ensuring the application of ERM’s Corporate Governance Approval Levels and Project Contract Approval Levels to all project contracts and related instruments (such as confidentiality agreements, deeds of variation and the like).
  • Apply ERM’s preferred contractual protections to project contracts and to promote the use of ERM’s standard terms where appropriate.
  • Provide support and advice on contract development and management issues, focus on contract development processes resulting in compliant governance practices, and manage key commercial risks.
  • Manage all formal contract-related documents and ensure that contract notices are served within the stipulated timelines.
  • Reviews, comment and manage commercial contract terms and conditions for projects and ensures they are applied in alignment with company’s policies and commercial targets.
  • Provide expert knowledge in the review and assessment of commercial contract terms and conditions for opportunities during the bidding process.
  • Act as Commercial Manager in support of the Project Manager in line with project and customer requirements

Qualifications

We are seeking someone with the following qualifications and attributes:

  1. The successful candidate will have experience in contract management and project management experience within an organization of similar scale and profile to ERM.
  2. The successful candidate will have excellent interpersonal skills and a high level of competency in terms of written and verbal communication, with outstanding attention to detail.
  3. The successful candidate will have a track record of delivering to challenging timelines, of proactive management of complex processes and of appropriate treatment of confidential and sensitive information.
  4. The successful candidate will be capable of offering advice, solving issues and meeting expectations, and be able to build strong and lasting professional working relationships with colleagues and stakeholders, and the confidence, acumen and enthusiasm to set high standards and deliver results.
  5. Candidates would preferably have a degree in law and tertiary qualifications in project management and finance.
  6. Excellent understanding of contract law and pricing.
  7. Proven experience in leading commercial solution development for large projects and tenders.
  8. Exposure to remote mining and/or power sector projects would be highly advantageous.
